The baby who featured on the cover of leading rock band Nirvana’s album is all grown up and has even filed a lawsuit against the group’s two surviving members.
According to him, the band failed to take any form of consent from his parents before using his n*ked images inside a swimming pool for the album’s cover. But while expecting to achieve millions from the lawsuit, his case has been dismissed.
Local media outlets revealed how 31-year-old Spencer Elden didn’t expect the case to go in this manner. He strongly felt that the proof and evidence he had in the form of child protection and p*rnography laws really didn’t allow such pictures to be published in public.
But to his surprise, that’s not the case and now he’s lost the lawsuit and clearly is not happy about it.
The lawsuit was filed against the band’s two surviving members and also Kurt Cobain’s estate. In addition to that, he also chose to involve a number of different record labels too, and the famed photographer behind the image, Kirk Weddie.
“None of my guardians gave permission. How was this even taken and then published by a famed rock band!”- he continued during his recent interview after losing the battle.
So Nirvana has won the lawsuit and that means all the defamatory allegations were dismissed recently by the judge handling the case. While this might not be the decision that the family was hoping for, fans and followers of the band were glad.
