A new FBI report has concluded that Alec Baldwin, 64, did pull the trigger of the gun that shot and killed cinematographer Halyna Hutchins, 42.
The actor accidentally shot Hutchins and injured director Joel Souza on the set of the movie Rust in Santa Fe, New Mexico, in October 2021.
Baldwin has firmly denied that he pulled the trigger but a new report from the FBI concluded that the gun, which was supposed to be loaded with dummy bullets, couldn’t have been fired unless the actor pulled the trigger.
This means that Baldwin could still face criminal charges.
Authorities said that they are waiting for Baldwin’s phone records, and the District Attorney has been working with Suffolk County Police and the actor’s lawyers to obtain them.
Detectives will review the records and a case file will be sent to the DA to determine if charges will be filed.
Part of the FBI report found that the gun, a single-action .45 Cold caliber F.lli. Pietta, couldn’t have been fired without a person pulling the trigger.
The decision was made by performing an accidental discharge test but it is not clear if it was with the same weapon or an identical one, ABC News reported.
It also states that the gun will not release a bullet and primer just by fiddling with the hammer, which Baldwin said what he was doing when the weapon fired.
The actor explained in an interview with ABC that he had pulled back the hammer while Hutchins was coaching him on the positions.
Baldwin reportedly told investigators that he was told that he was using a ‘cold gun,’ which was supposed to be loaded with dummy rounds.
The report could lead to criminal charges against Baldwin as well as others involved in the shooting.
Santa Fe police are still investigating the cinematographer’s death.
