According to Page Six, Zohar’s mother Alexis Adams has filed a lawsuit claiming that the windows in their flat ‘posed a hazardous condition’ that allowed the heartbreaking incident to happen.

James Lucas, who lives on the 6th floor of the apartment building, told Daily Mail that he was downstairs when the child fell.

Emergency services filled the side of the building where the 40-year-old said he saw Zohar splayed ‘lifeless’ on the concrete.

“I was just downstairs getting Chinese food and there were ambulance everywhere and I had no idea what had happened I just saw the kid, he looked lifeless,” the shocked neighbor continued.

“I didn’t even realize it was from the 5th floor until later.”

Lucas said that the windows in the apartment block have a sill that a child could ‘definitely stand on.’

“You can definitely, if you’re a kid, stand on that sill, but my kids haven’t been here I think they should look into window guards for sure,” he went on.

“I couldn’t believe he survived that, I mean the 5th floor, that’s a drop. I was only down there for a few minutes, he was down there when I got there.”

In a statement, Adams said: “As a single mom to a special needs child, this feels like a nightmare. My heart is broken into a million pieces.

“I am devastated, angry and struggling to come to terms with the fact that my only child has suffered severe injuries due to willful negligence of our landlord and others involved in failing to take necessary safety measures.”
