The accident came to light after Alexis Adams, the boy’s mother, launched a lawsuit in which she accused the apartment building’s owners and managers, along with the window installers and the construction company, of introducing windows that “posed a hazardous condition.”

The health update comes shortly after a neighbor of Adams spoke out and recalled the shocking moment the boy fell to the concrete ground beneath his 5th-floor apartment.

“He was just on the ground, not moving, I thought he wasn’t going to live. I was just downstairs getting Chinese food and there were ambulance everywhere and I had no idea what had happened I just saw the kid, he looked lifeless,” the witness, James Lucas, said.

“I didn’t even realize it was from the 5th floor until later.”

Lucas, too, appeared to question the windows’ safety by adding: “You can definitely, if you’re a kid, stand on that sill, but my kids haven’t been here. I think they should look into window guards for sure.

“I couldn’t believe he survived that, I mean the 5th floor, that’s a drop. I was only down there for a few minutes, he was down there when I got there.”
