Furious parents of a young boy have sued a hospital for $500,000 after doctors performed a vasectomy on the child during surgery for a hernia.

Parents of a 4-year-old boy only identified as R. B. were left devastated and shocked after a hernia surgery at the Texas Children’s Hospital resulted in an unwanted vasectomy.

According to ABC 13, Dr. Susan L Jarosz recommended a hernia surgery to the parents of the young boy in 2021 after he complained about pain and swelling in his scrotum. On August 4, following the doctor’s recommendation, the boy underwent the right inguinal hernia repair procedure at the hospital.

As the court documents state, the surgery didn’t go as planned, whereas Dr. Jarosz allegedly also cut the child’s right vas deferens, also known as sperm duct, in the process.

“While apologies were given, full accountability was not accepted. The parents now face the difficult task of explaining this to their son at the appropriate age,” the parents’ attorney, Randy Sorrells, said in a statement.

The parents have since launched a lawsuit against Texas Children’s Hospital and Dr. Jarosz, a Baylor College of Medicine assistant professor, and are seeking $500,000 in damages – the maximum allowed by the state in such a case.

According to the lawsuit, the doctor “breached the standard of care by failing to exercise ordinary care while performing hernia repair surgery on the little boy.”

Furthermore, the suit argues that the doctor failed “to properly position and separate the hernia sac from the vas deferens before removing it surgically.”

Blasting the doctor was also Sorrells who in an interview with FOX News said: “I’ve seen this mistake happen in different cases, but never a surgeon who cuts the vas deferens of a four-year-old.

“That’s very rare, but it’s pretty simple. You properly identify the anatomy before you cut it.”

Following the incident, the parents of the 4-year-old remain concerned about the physical and mental impacts the botched procedure will have on their son who will likely struggle with infertility issues and might not be able to father children naturally in the future.

“The worse long term effect is the impact on the four-year-old’s reproductive process that will require him to go through artificial reproductive procedures. I don’t think it’ll be an impossibility to have children, but it could make it more difficult,” Sorrells added.

As the lawsuit states, the botched procedure will lead to “future medical expenses, future pain, mental anguish, future disfigurement, physical impairment and future expenses for fertility treatments” on top of “unfathomable” effects on the boy’s “emotional and psychological” health.
